Terms of Service
1. Acceptance of Terms
By downloading, installing, or using Dictation Pro ("the App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use the App.
2. Description of Service
Dictation Pro is an iPhone application built by DevOrbit Labs that provides:
- Real-time speech-to-text transcription in 47 languages and accents (on-device).
- Audio file import and transcription (MP3, M4A, WAV, AAC, AIFF, CAF) up to 100 MB.
- Optional AI enhancement: auto titles, AI cleanup, AI summary packs, and Ask AI for transcripts.
- Optional high-accuracy cloud transcription via our AI Gateway.
- On-device translation in 29 languages (iOS 18+).
- Export as PDF, DOCX, or plain text using six template formats.
- Transcript organisation with folders, tags, bookmarks, and full-text search.
3. Subscription and Payments
Dictation Pro offers the following plans, processed through Apple's App Store:
- Annual — recurring subscription with a 7-day free trial for new subscribers.
- Lifetime — one-time purchase for permanent access.
Pricing is shown in your local currency at checkout. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Renewals charge the same Apple ID at the price disclosed at signup.
4. Free Trial
The Annual subscription includes a 7-day free trial for first-time subscribers. Cancel before the trial ends and you will not be charged. After the trial ends, the subscription automatically converts to a paid subscription at the disclosed annual rate.
5. Cancellation and Refunds
Cancel any time from your Apple ID subscription settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple under their refund policies; we cannot issue refunds directly.
6. User Responsibilities
You agree to:
- Use the App only for lawful purposes and in compliance with applicable laws.
- Comply with consent and recording laws in your jurisdiction. You are responsible for obtaining permission before recording other people.
- Not transcribe content that infringes the rights of third parties.
- Not reverse engineer, decompile, disassemble, or attempt to extract the source code of the App.
- Not abuse, overload, or attempt to bypass rate limits on our AI Gateway.
- Not use the App or its outputs to build a competing service.
7. AI Features & Acceptable Use
AI features (titles, cleanup, summaries, Ask AI, high-accuracy cloud transcription) are provided on an opt-in basis. By invoking an AI feature you acknowledge that:
- The relevant transcript text or audio will be transmitted to our AI Gateway and forwarded to OpenAI for processing.
- AI output may be inaccurate, incomplete, or biased. You should review AI-generated content before relying on it.
- You will not submit content that is unlawful, harmful, infringing, or that you do not have the right to process.
- We may rate-limit, throttle, or suspend AI access to prevent abuse.
8. Intellectual Property
The App, its design, source code, branding, and AI prompts are owned by DevOrbit Labs and are protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the App on devices you own or control.
9. Content Ownership
You retain full ownership of the recordings, transcripts, summaries, and exports you create with the App. We do not claim any rights to your content. We do not store your content on our servers — it lives on your device.
10. Privacy
Your use of the App is also governed by our Privacy Policy, which describes what limited information we process and how AI features handle data.
11. Disclaimer of Warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that:
- The App will meet your specific requirements.
- The App will be uninterrupted, timely, or error-free.
- Transcription, translation, or AI-generated output will be 100% accurate.
- All defects will be corrected.
12. Limitation of Liability
To the maximum extent permitted by law, DevOrbit Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses arising from your use of, or inability to use, the App. Our total liability under these Terms is limited to the amount you paid for the subscription in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless DevOrbit Labs and its affiliates from any claims, damages, losses, or expenses arising from (a) your use of the App, (b) your violation of these Terms, or (c) your violation of any law or third-party rights.
14. Third-Party Services
The App integrates with the following third-party services. Your use of them is subject to their respective terms:
- Apple — Speech Framework, Translation Framework, App Store, in-app purchases.
- RevenueCat — Subscription state management.
- Mixpanel — Anonymous analytics.
- Vercel — Hosting for our AI Gateway serverless functions.
- OpenAI — Processing of opt-in AI requests.
15. Changes to Terms
We may modify these Terms from time to time. Material changes will be communicated via the in-app release notes and the "Effective" date at the top of this page. Continued use after a change constitutes acceptance.
16. Termination
We may suspend or terminate your access to AI Gateway features if you breach these Terms. You may terminate by uninstalling the App and cancelling any active subscription. Sections 8–13 survive termination.
17. Governing Law
These Terms are governed by the laws of the jurisdiction in which DevOrbit Labs operates, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer protection laws apply.
